One of the best things about what I do is getting to help employers with compliance problems. I recently had a broker contact me about one of their clients who received the dreaded IRS 226-J letter assessing a $15,000 ACA penalty for 2020. The client's payroll vendor completed their 2020 ACA reporting and used incorrect coding on their Forms 1094 and 1095 that caused a penalty to be assessed. After discovering and fixing the coding errors, we were able to help the client get all penalties waived. It may seem like a good idea to use your payroll vendor to complete your ACA reporting. But payroll vendors simply rely on software system algorithms to calculate the applicable reporting codes to include on the Forms 1094 and 1095. ACA reporting is complicated and payroll vendors lack a human touch with the expertise to identify and avoid possible coding errors that can result in penalties. We have created this instructional video to assist employers in completing the Gag Clause Attestation. Most of the carriers are submitting the attestation on behalf of their fully-insured clients. However, Humana is NOT and employers will be required to complete the attestation on their plan's behalf. Many self-funded TPAs and PBMs are also not completing the attestation which puts the onus on the employer.
